Step 3. Search for tenders and study of documentation

Step 4. Opening a special account

Step 5. Preparation and submission of an application for participation

The participant's application is in electronic or paper form, drawn up in full accordance with the requirements of the procurement documentation. Documents must be certified by an authorized person of the participant and contain reliable information. A separate instruction will not interfere here. It will not work to place a notice without entering these positions into the schedule, and therefore the schedule must be approved with changes 10 days before the notices are posted in the EIS.

Do not forget that from January 1, 2016, articles related to planning and regulation came into force. In accordance with this, when planning purchases for 2017, do not forget to preliminarily draw up a Procurement Plan for 2017 and place it in the EIS. This must be done within 10 days after the approved limits of budget commitments are reached. Within 10 days after that, you will need to place the Schedule in the EIS, and only after that you will be able to purchase goods, works, services in accordance with Federal Law No. 44 in 2017. Please note that in FZ-44 in some cases we are talking about working days, and in others - about calendar days. AT this case we are talking about calendar days.
If the purchase amount is less than 100,000 rubles, then the purchase can be made under clause 4 of part 1 of Article 93, and if the amounts exceed 100,000 rubles, then these services will need to be purchased under other clauses of part 1 of Article 93 of Federal Law No. 44. Requirements for the participant of the electronic auction

The procurement participant must comply with the requirements of the legislation on public procurement:

  8. The participant must not be an offshore company.

Also, an electronic auction is held in relation to goods (works, services) included in the additional list, which is approved by the supreme executive body state power subject of the Russian Federation, if the purchase is carried out to meet the needs of the corresponding subject of the Russian Federation (part 2 of article 59).

Closed ways to determine suppliers

Used only in the following cases:

  • purchases of GWS required to meet federal needs, if information about such needs constitutes a state secret;
  • procurement of GWS, information about which is a state secret, provided that such information is contained in the procurement documentation or in the draft contract;
  • conclusion of contracts for the provision of services for insurance, transportation and protection of valuables of the State Fund of Precious Metals and Precious Stones of the Russian Federation, for the provision of services for insurance, transportation, protection of museum objects and museum collections, rare and valuable publications, manuscripts, archival documents (including their copies), having historical, artistic or other cultural significance and transferred by customers to individuals or legal entities or accepted by customers from individuals or legal entities for temporary possession and use or for temporary use, including in connection with holding exhibitions on the territory Russian Federation and (or) territories of foreign states;
  • procurement of cleaning services, services of drivers to ensure the activities of judges, bailiffs.

There are no other restrictions on determining a supplier through an electronic auction.

  • independently viewing information on the official website using keywords- this option is free, but requires constant monitoring by the participant, because everything has to be done by oneself;

Only after you analyze the information about ongoing and completed electronic auctions, you can choose those that are right for you and prepare to participate in them.

The participant must carry out preliminary analysis and calculation before deciding to participate in public procurement. After he has made a decision to participate in the auction under the law 44-FZ, you need to find information about those purchases that are of interest to him and prepare all necessary documentation. Then you need to carefully check whether the information contained in the prepared documentation corresponds to the customer's requests.

The participant may need legal assistance, so you should involve your own legal service, and if there is none in the participant’s company, then contact an outside lawyer to study the provisions of the customer’s draft contract and determine possible risks. The participant must also plan in advance their financial resources to secure the application, and in case of victory - to ensure the execution of the contract. And only after that you can apply. Here, in fact, is the starting point from which the long path of participation in public procurement begins.

  • the procedure for securing applications has been revised.

New e-procurement

From 07/01/2018, in addition to the electronic auction (EA), customers will be able to conduct the following procurement procedures in electronic form:

  • open tender (OK);
  • competition with limited participation;
  • two-stage competition;
  • request for proposals (RFP);
  • request for quotation (RFQ).

There is also the possibility to carry out closed tenders in electronic form at specialized sites.

Electronic procedures will be faster than paper ones:

  • OK: publication of the notice - no later than 15 p. e. before the deadline for submission of applications (art. 54.2); consideration and evaluation of the first parts of applications - no more than 6 rubles. if the NMTsK is less than 1 million rubles. - 1 p. e. (art. 54.5); the second parts - no more than 3 p. etc., with NMCC less than 1 million rubles. - 1 p. e. (art. 54.7);
  • ZK: publication of the notice - no later than 5 p. e. before the deadline for accepting proposals; consideration - 1 p. e. (art. 82.2);
  • ZP: publication - for 5 rubles. d.; consideration - 1 p. e. after the acceptance of the final proposals (art. 83.1).

List not defined at this time electronic platforms operating under the new rules. For now, you can use the previous platforms that work with public procurement.

From 01.01.2019 it will be possible to conduct only electronic tenders, except for certain types:

  • tenders held abroad;
  • for urgent, humanitarian aid;
  • at emergency situations;
  • closed procedures;
  • sole supplier;
  • by decision of the Government of the Russian Federation.

Electronic auction - what has changed

For the first part (part 3 of article 66):

  • the participant, using hardware, agrees to the supply of GWS in accordance with the documentation;

For the second part, requirements have been added (part 5 of article 66):

  • indicate the postal address of the organization;
  • send documents confirming the benefits;
  • in the presence of national regime - documents confirming the country of origin. Their absence is not a basis for rejection, but is considered as an offer of foreign GWS.

The auction step is now at least 100 rubles. (part 6 of article 68).

Supplier identification procedure: new norms

Planning: if, after a failed purchase, the customer made a change to conduct a second one, then you do not need to wait 10 days to publish the corresponding notice. From July 1, this pause has been reduced to 1 day (part 14, article 21).

Compiling documentation:

  • when describing an item, it is allowed to indicate a trademark with the words “or equivalent” or to ensure compatibility with existing products (clause 1, part 1, article 33);
  • in the requirements for participants, the absence of legislative restrictions on participation in procurement was added (clause 11, part 1, article 31);
  • it is impossible to establish the security of the application at the NMTsK up to 1 million rubles. The amount is determined according to the scheme: NMTsK up to 20 million rubles. inclusive - 0.5-1%; NMTsK more than 20 million rubles. - 0.5-5%.
