The legislation of the Russian Federation establishes several types of workbook forms recognized as valid and not subject to mandatory replacement:

A bit of history...

The work book of a collective farmer of the 1977 model was at one time the main document on the labor activity of a collective farm member and was kept on all collective farms, including fishing ones, for all collective farmers from the moment they were accepted as members of the collective farm.

Labor books were handed over in a solemn atmosphere at general meeting collective farmers or at meetings of collective farmers of a section, brigade, farm and other production units. Now such a rule of law seems amusing, but at that time the receipt of a work book by an employee of a collective farm was a personally significant event, and on a national scale, frankly, historical! After all, Decree No. 310 was both social and political in nature. It seemed to equalize collective farmers in rights with workers and employees (including state farms), to whom work books were issued on letterheads in accordance with the decree of the Council of Ministers of the USSR and the All-Union Central Council of Trade Unions dated 09/06/1973 No. 656 “On work books of workers and employees”.

The boards of collective farms were obliged to strictly observe the established procedure for maintaining work books and ensure the proper storage of archival documents related to the labor activity of collective farmers.

Not only administrative, but also public control was envisaged for the timely and correct filling of labor books of collective farmers, their accounting, storage and issuance. It was carried out audit commissions, trade union committees of collective farms and collective farm councils social security. Based on the results of the control measures, they developed recommendations for the collective farm board to take measures to eliminate the identified shortcomings.

However, back to our situation. What happens if the candidate interviewed, when applying for a job, will he present to the personnel officer the work book of the collective farmer? To what extent is it legal to conduct it at the present time? After all, we are all now using new samples of the work book, the form of which was approved by the Decree of the Government of the Russian Federation of April 16, 2003 No. 225 “On work books” (hereinafter - Resolution No. 255).

In paragraph 2 of Decree No. 255, the legislator provided that the work books of the previously established sample that employees have are valid and cannot be exchanged for new ones.

Does this apply to the work books of collective farmers? If we consider Decree No. 255 by itself, it turns out that the work book of a collective farmer can be both accepted and kept, making, if necessary, all the required entries reflecting the labor activity of the employee. However, if we consider normative legal acts in their complex interaction, we can see that everything is not so simple!

After all, we repeat, the work book of a collective farmer is the main document on the labor activity of a collective farm member and is kept on all collective farms, including fishing ones, for all collective farmers from the moment they are accepted as members of the collective farm. The form of the work book of the collective farmer reflects, among other things, information about membership in the collective farm, about being assigned to work, about transferring to another job, about labor participation in the public economy, etc.

What to do? In practice, there are several options for action. Let's evaluate each of them.

Option 1. "Legalize" the entries made in the work book of the collective farmer after 2004.

Please note: the work records entered in the collective farmer's work book are not illegal, incorrect or erroneous. They are correct and accurate, just made on the wrong form. Accordingly, they cannot be recognized as valid or somehow corrected.

Option 2. Issue a duplicate work book to the employee.

But with what circumstances does Decree No. 255 connect the issuance of a duplicate?

Circumstance 1. The employee has lost his work book.

A common situation in HR practice. The employee is obliged to immediately declare this to the employer at the last place of work, which issues a duplicate of the work book to the employee no later than 15 days from the date of application.

According to the Rules for calculating and confirming the insurance period for determining the amount of benefits for temporary disability, for pregnancy and childbirth, approved. by order of the Ministry of Health and Social Development of Russia dated February 6, 2007 No. 91 (hereinafter referred to as the Rules), the work book of a collective farmer is considered as a document confirming the period of work of a member of the collective farm for inclusion in the insurance period.

In accordance with paragraph 2 of the Rules, the length of service includes the periods of work of a member of a collective farm, a member of a production cooperative, taking personal labor participation in its activities, before January 1, 2001, as well as periods of this work for which social insurance payments were paid, after 1 January 2001.

The periods of work of a collective farm member are confirmed for the period before January 1, 2001 by a work book (collective farmer's work book), and for the period after January 1, 2001 - by a work book (collective farmer's work book) and a document of the collective farm, production cooperative on payment of social insurance payments (clause 16 of the Rules)

Circumstance 2. The employer made a negligence, which led to the massive loss of work books.

The procedure for the employer and the commission to establish the length of service in this situation is regulated by paragraph 34 of Resolution No. 255.

Circumstance 3. The employer has lost the employee's work book.

Unfortunately, this situation is also possible. And note that the legislation does not regulate the way out of it. However, unless otherwise established, the employer should be guided by the general rules and issue a duplicate of the work book to the employee, filling it out, guided by paragraphs 7.1 and 7.2 of the Instructions for filling out work books, approved. Decree of the Ministry of Labor of Russia dated October 10, 2003 No. 69.

Circumstance 4. The employer made an entry in the work book about dismissal or transfer to another job, recognized as invalid.

In this case, the employee, upon his written application, is issued a duplicate of the work book, where all entries from the work book are transferred, with the exception of the entry declared invalid.

Circumstance 5. The work book (insert) has become unusable (burned, torn, soiled, etc.).

Thus, issuing a duplicate general rule associated with the actual loss or damage to the original work book. Exception - entries invalidated are made in the work book. In our situation, the work book of the collective farmer is not lost or damaged, and the entries in it, as we said above, are correct and legal.

Accordingly, we cannot issue a duplicate work book to an employee in this situation.

Option 3. Issue a new work book.

We believe that this is the most correct way out of the situation. Get the former collective farmer a work book of the established form, but the old one ... What to do with it? Throw away? In no case!

This document plays an important role in establishing the periods included in the length of service for determining the amount of benefits for temporary disability, pregnancy and childbirth for citizens subject to mandatory social insurance in case of temporary disability and in connection with motherhood, in accordance with the legislation of the Russian Federation.

So, the work book of a collective farmer can be accepted from an employee and kept in the prescribed manner only if your organization is a collective farm.
